VoiceSketch

By downloading, installing, or using VoiceSketch ("the App"), you agree to be bound by these Terms of Service ("Terms") and End User License Agreement ("EULA"). If you do not agree to these Terms, please do not use the App. These Terms constitute a legally binding agreement between you ("End-User") and Kairos AI Tech ("we," "us," or "our"), the developer of VoiceSketch. These Terms are not between you and Apple Inc. ("Apple"). Kairos AI Tech, not Apple, is solely responsible for the App and its content. Your use of the App is also governed by our Privacy Policy, which is incorporated by reference into these Terms. You must be at least 13 years old to use this App. If you are under 18, you confirm that you have obtained parental or guardian consent to use the App.

We grant you a non-transferable, non-exclusive license to use VoiceSketch on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. • This license does not allow you to use the App on any device you do not own or control • You may not distribute or make the App available over a network where it could be used by multiple devices at the same time • You may not rent, lease, lend, sell, redistribute, or sublicense the App • You may not copy, reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the App The terms of this license must not conflict with the Apple Media Services Terms and Conditions. In the event of any conflict, the Apple Media Services Terms and Conditions shall govern.

VoiceSketch is a mobile application that provides: • Real-time audio recording and transcription services • AI-powered text summarization capabilities • Visual representation generation from meeting content • Cloud storage and synchronization (premium feature) • Export functionality for transcripts, summaries, and visualizations The App integrates with third-party services including OpenAI for AI processing and Firebase for data storage and authentication. We reserve the right to modify, suspend, or discontinue any aspect of the service at any time.

Kairos AI Tech is solely responsible for providing any maintenance and support services for VoiceSketch, as specified in these Terms or as required under applicable law. • Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App • Support is available via email at kairos.ai.tech@gmail.com • We aim to respond to support inquiries within 5 business days • App updates are provided through the Apple App Store • We may release updates to fix bugs, add features, or address security issues • Continued use of the App after updates constitutes acceptance of any changes

Account Creation: • You must provide accurate and complete registration information • You are responsible for maintaining the confidentiality of your account credentials • You must be at least 13 years old to create an account • Each user may maintain only one account Account Security: • You are solely responsible for all activities under your account • Notify us immediately of any unauthorized use of your account • We are not liable for losses due to unauthorized account access Account Verification: • Email verification is required for full account functionality • Unverified accounts have limited access to features

You agree NOT to use VoiceSketch for: Prohibited Activities: • Illegal activities or violation of applicable laws • Recording conversations without proper consent • Harassment, threats, or abusive behavior • Sharing copyrighted content without permission • Uploading malicious code or attempting to hack the service • Creating fake accounts or impersonating others • Spamming or sending unsolicited communications • Commercial use without proper licensing Content Restrictions: • No hate speech, discriminatory, or offensive content • No personal information of others without consent • No content that violates privacy rights • No misleading or fraudulent information Violation of these terms may result in account suspension or termination.

VoiceSketch Intellectual Property: • The App, including design, code, and features, is owned by VoiceSketch • All trademarks, logos, and service marks are our property • You may not copy, modify, or distribute our intellectual property Your Content: • You retain ownership of your original recordings and content • You grant us a license to process your content to provide services • You are responsible for ensuring you have rights to all uploaded content • We do not claim ownership of your personal recordings or transcriptions AI-Generated Content: • Summaries and visualizations are generated using AI services • You have rights to AI-generated content based on your input • We do not use your content to train AI models without consent Third-Party Content: • Respect copyright and intellectual property rights of others • Obtain proper permissions before recording others Intellectual Property Claims: • Kairos AI Tech, not Apple, is responsible for the investigation, defense, settlement, and discharge of any third-party intellectual property infringement claim related to the App

Your privacy is important to us. Our data practices are governed by our Privacy Policy, which includes: Data Collection: • We collect minimal data necessary for app functionality • Audio recordings are stored locally by default • Cloud storage is optional and encrypted Data Use: • Personal data is used only to provide and improve services • We do not sell personal information to third parties • Analytics data is anonymized and aggregated Data Protection: • Industry-standard encryption for data in transit and at rest • Regular security audits and updates • Compliance with GDPR, CCPA, and other privacy regulations Your Rights: • Access, correct, or delete your personal information • Export your data in portable formats • Opt out of optional data collection For complete details, please review our Privacy Policy.

Premium Subscriptions: • Premium features are available through in-app purchase subscriptions • Subscriptions automatically renew unless cancelled • Pricing and features are subject to change with notice Payment Terms: • Payments are processed through Apple's App Store • All fees are non-refundable unless required by law • Prices include applicable taxes where required Cancellation: • Cancel anytime through your App Store account settings • Access to premium features continues until the end of the current billing period • No partial refunds for unused subscription time Free Trial: • Free trials may be offered for premium features • Trial converts to paid subscription unless cancelled • Previous trial users may not be eligible for additional trials Changes to Pricing: • We may change subscription prices with 30 days notice • Price changes apply to new subscriptions and renewals

Warranty: • Kairos AI Tech is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App (if any) • To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App Service Disclaimers: • VoiceSketch is provided "as is" without warranties of any kind • We do not guarantee 100% accuracy of transcriptions or AI-generated content • Service availability may be subject to interruptions or maintenance • Third-party integrations may affect app functionality Product Claims: • Kairos AI Tech, not Apple, is responsible for addressing any claims relating to the App or your use of it, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation Limitation of Liability: • Our liability is limited to the amount paid for the service, to the extent permitted by applicable law • We are not liable for indirect, incidental, or consequential damages • We are not responsible for data loss due to device failure or user error • Users are responsible for maintaining backups of important data AI and Transcription Accuracy: • AI-generated summaries and transcriptions may contain errors • Users should review all generated content for accuracy • We recommend human verification for critical or sensitive content • Accuracy may vary based on audio quality, accents, and technical terms Third-Party Services: • We are not responsible for third-party service interruptions • OpenAI, Firebase, and other integrations have their own terms • Changes to third-party services may affect app functionality

You agree to indemnify, defend, and hold harmless VoiceSketch and its officers, directors, employees, and agents from and against any claims, damages, losses, or expenses arising from: • Your use of the App in violation of these Terms • Your violation of any applicable laws or regulations • Recording others without proper consent or authorization • Copyright infringement or intellectual property violations • Any content you upload, share, or process through the App • Unauthorized use of your account due to your negligence This indemnification survives termination of your account and these Terms.

Termination by You: • You may delete your account at any time through the app settings • Cancellation of subscriptions must be done through the App Store • Your data will be deleted according to our data retention policy Termination by Us: • We may suspend or terminate accounts for Terms violations • Termination may be immediate for serious violations • We will provide notice when possible, except for immediate safety concerns Effect of Termination: • Access to the App and services will be immediately revoked • Your data will be deleted according to our Privacy Policy • Premium subscription benefits will cease immediately • These Terms survive termination where applicable Data Recovery: • Deleted accounts cannot be recovered • Export your data before account deletion • We may retain some data as required by law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles. Dispute Resolution: • Informal Resolution: Contact us first to resolve disputes informally • Arbitration: Disputes will be resolved through binding arbitration • Class Action Waiver: You waive the right to participate in class actions • Jurisdiction: Courts in the State of California have exclusive jurisdiction Exceptions to Arbitration: • Small claims court matters under jurisdictional limits • Intellectual property disputes • Injunctive relief requests Third-Party Beneficiary: • You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms • Upon your acceptance of these Terms, Apple shall have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary Legal Compliance: • You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country • You are not listed on any U.S. Government list of prohibited or restricted parties

We reserve the right to modify these Terms at any time. Changes will be effective when: • Posted within the App with updated "Last modified" date • Notification sent to registered email addresses • For material changes, 30 days advance notice will be provided Your Options: • Continued use of the App constitutes acceptance of changes • If you disagree with changes, discontinue use and delete your account • Some changes may be required by law or for security reasons Version Control: • Previous versions of Terms are archived and available upon request • The current version always supersedes previous versions
